I have recently resigned and my employer is holiding back my last months salary and commission which is allot more than my outstanding tax bill - can someone pls advise me on how much companies are allowed to hold back.  My employer has no real idea on this matter - just says it is what companies do.

I think they are holding your last month pay for clearance with the income tax. Which means whatever left over amount after deducting the income tax, they will have to return to you.

My ex-employer has held back 3 months salary of mine and I just got back my tax bill which is less than an 1/8 of it.  They have not returned the money as they say that they are experiencing financial difficulties - I have tried the MOM but been told that I cannot get assistance as my title included the word manager - anyone know any good lawyers I can speak to?
