Hi folks,

I have signed a contract with a Singapore company a few months ago and still be waiting for my S pass. Due to some family reason, I have to terminate this contract recently. As I have not been there to start yet, I am wondering is there any reasponsbility that I have to take?

Any experienced people got this similar issue before? Any comment? Thanks in advance! Look forwrad to your reply!

Have you started on the job yet? If not, there should be no responsibility on your part? Any clause on your employment contract that states this?

Thanks for the replies! I have not started yet. I am still in oversea now. According to the contract in the section of "termination", I should give 2 months' written notice of termination. I am wondering what is happened if I can not give such 2 months' notice in my situation.

I think that depends on what is written in commencement of your contract.
Usually, it should be defined as upon approval your VISA.
If your S Pass has not been issued, it shouldn't be a problem on your side.
Otherwise, you might need to worry about possible responsibilities.

I made a similar move just last week. My S pass was still not approved after one month and hence i terminated the contract. However, there's a clause in the contract that states that the employment will only start upon the approval of the pass. Therefore my reasoning is that as long as the pass is not approved yet, or not approved at all, the contract will not be effective at all. The notice period and any other compensations for cancelling the employment will then become redundant.

I called up the company and told them that the pass is taking too long to process and I don't want to wait any further. So we agreed to cancel the contract with no strings attached to both parties. =)

it depends on your contract that you signed with the company. like notice period, termination penalties etc. negotiate to work something out with ur company.
