HI

I need to make a point to my ex-employers who decided to sack me after 10 years' service - when I was off work with a broken leg!

As I was technically on leave (I had holiday time owed to me, which I decided to use following my medical leave - all agreed by the company), the company feel that they have done nothing wrong. And are only willing to give me the statutory pay of just 1 month - even though others, in the past, have been given a month for every year.

While out of order, legally you are stuffed.  Just move on.

One caveat, if you were moved here by them and especially if on expat terms could go for stat minimum in home country. Tough but maybe worth a go.

I would consider engaging a solictor to help you out here. He could sort out a court or out of court settlement

No they won't, they will get whatever is in the contract.

Employee proection in law here is essentially zero, paying a lawyer is just wasting money.

My guess is there's more to it than you are saying.  If you were a good employee for 10 years it is unlikely they would sack you just for being out with a broken leg.  You don't say how long you were out or the nature of your work or why you needed vacation time following the approved medical leave.  Or why they said they were making you redundant.

And now you want more in compensation than is called for in your contract?

Hmmm.  I'm a bit suspicious.

Some companies here have very limited sickness time. I work for a major MNC and its something like 15 days a year outpatient MC with in hospital absence allowed about the same.

I had a herniated dick in my neck two years ago which took some time - luckily in my department they just let me stay off and did not even put it in the system

There are some dirty, nasty ratbag employers here.  You may be on sick / study / home leave.  But you receive a rude shock - your job is being advertised while you're away!

I also guess there is more to it than you're telling....

why are you being made redundant ??
